He said he wouldn't because so many songs sound the same throughout rock n roll, especially blues music. He also said he was a fan. It was a radio DJ and Petty fans who called for him to sue. Also..Petty's keyboard player Benmont Tench played on this Jayhawks song so there is no way in hell he didn't know about how similar Mary Jane's Last Dance was because he was on both damn songs. Dani California on the otherhand was inspired by Sweet Home Alabama and John Fruciante listening alot to Wu Tang Clan. He was interviewed alot and asked about the inspiration and even before there was the whole RHCP/Petty b.s.. Petty never sued the Peppers.
